it is my understanding that folks have the right to use the water, and that this right extends so far as to mandate that an individual may walk along ANY shore line, regardless of property ownership, so long as they stay within the high and low tide markers. or below the low tide if they feel so inclined, i suppose. does this imply that property begins at the high tide mark?
lately i have been taking my skiff from a public island over to a place of private property, landing on the shore and fishing from this spot. i am remaining between the high and low tide marks, most of the time i am in the water itself. if i had walked here, i believe i would be within my legal rights. but do these rights extend to my skiff as well? it remains in the water, although its anchor rests on the shore.
i am in the state of ma, if that matters at all. it would be nice to lift a certain element of paranoia brought about by this potential tresspassing, and i would like to be able to return again, as it is from this shore that i hooked the hardest fighting fish i have been attached to.
